Both Dru and Barrett have over 26 years of experience representing people accused of a wide range of state and federal offenses. Both have successfully defended clients in First Degree Murder trials.  In their first trial working together in 1998, despite seemingly insurmountable evidence, Dru and Barrett achieved a “not guilty” verdict for their client.

Of course, not every case goes to trial.  Dru and Barrett have also achieved success in pre-filing and pre-indictment scenarios persuading prosecutors not to pursue charges against innocent clients.  They have handled many cases over the years where they have convinced the government to drop charges or dismiss the case althogether.  Dru and Barrett listen to their clients’ individual goals, working with their clients to achieve those results.

The government is increasingly initiating criminal investigations and prosecutions against employees, executives, and companies.  White-collar cases often involve complicated issues and thousands and pages of documents.  At Nielsen Weisz, we are not intimidated by volume.  We know that to successfully defend these accusations, we must bring the same passion and dogged determination to understand the facts and fight off innuendo.  We have extensive experience representing witnesses, subjects, and targets in grand jury investigations and have successfully represented white-collar defendants in precedent setting federal and state trials.

Insurance Bad Faith

Nielsen Weisz has substantial experience in all aspects of insurance bad faith litigation.  Insurance companies often do not play fair – even with the person or company who has paid them to provide insurance. Colorado law requires that insurance companies act reasonably and fairly when handling insurance claims. If they do not, they have acted in bad faith towards their policyholder and Colorado law provides for substantial damages to the policyholder including three times the amount of the claim, plus attorney’s fees. 

Insurance cases may also require personal counsel. In addition to the lawyer appointed by the insurance company, personal counsel is often necessary to ensure that the insurance company is handling the matter in the policyholder’s best interests. This is particularly important where the insurance company does not acknowledge its obligation to cover the claim in full or the policy limits are insufficient to cover the claimed damages.

Bad faith cases are not necessarily about how much money is at stake or what the policyholder may have done, but they are always about the bad behavior of the insurance company. Nielsen Weisz has fought for and obtained significant settlements and verdicts for clients focusing on the unreasonable and unfair behavior of the insurance company.

PERMANENT CIVIL PROTECTION ORDERS

Permanent Civil Protection Orders

Those accused of wrongdoing by another person may be served with a civil protection order. While the granting of a permanent civil protection order against a respondent does not directly lead to a jail sentence, there are significant and important consequences.  At Nielsen Weisz, we draw on our vast trial experience to provide litigants top-notch representation in permanent protection order hearings and in post-order hearings to modify or dismiss permanent protection orders.
